I bought insurance for my truck. after 3 months of paying my agent i noticed that my financing bank had added 1300 dollars to my loan as a collateral insurance because they did not have proof of my insurance. (about 400 per month since im 20). my agent does not want to refund the money for those 3 months, and they do not want to give me a proof of policy. I do have proof of paying them for those 3 months since I payed with a check that they cashed. I want them to give me proof of insurance for those 3 months or to pay 1300 to my loan because they are charging it due to their fault since they forgot to send my payment. Can I do a civil law suit for those 1300. I have proof of my payment for those 3 months. I also have my policy number but it says it's cancelled due to non payment so bank will not accept that as insurance. right after those 3 months I opened a new policy with them and ive had it for 8 months and ive always payed on time. I recently noticed that when they opened the new policy they inputed my date of birth as if i was 40 years old instead of 20. I do not know if they did a mistake or if they did that on purpose to give me a better price. The thing is that all these 8 months I've been paying i was actually never covered since my date of birth was way wrong. Only my name was correct but I talked directly to the insurance and not my agent and they explained to me that if i would have crashed it wouldnt have covered me since they do not have the correct date of birth. I just fixed that directly with the agent and now they have the correct date of birth so the insurance price went up since im only 20. I dont mind about that. I just think it's unfair that i paid for almost a year and that i was actually never covered because they did a mistake on my information. Plus they caused the bank to charge me.. So i just feel like if all this has been a big scam since i paid so much and did not have insurance. Can I sue them to get my money back or at least pay the bank what the bank is charging me for not having insurance.. like i said i have all the recepits of all payments ive done and i also have a copy of the policy where my information is not accurate and how i was paying without being covered. Nobody was hurt, and all cars were drivable, so we decided to not call the police we just all exchanged information. After we had finished and they left I immediately called my insurance lady to let her know what happened. I am not super clear on this next part, we have been going back and forth with our insurance since that call and will continue to fight it. When I called the insurance lady she said I wasnt covered. She said that they had received the last payment much later than it was due (not sure how because it was mailed the same time as always) but because of that our insurance had been cancelled. A couple of weeks ago they had chased our check, she said we were reinstated as of yesterday (the day of the accident) but because it was the same day they werent liable to pay the damages. We are going to keep fighting them because I dont think its fair. Even if they decide that they wont pay we can afford to just pay for the damages to the rear end of the car in front of us, because know matter what happened I am at fault for following to close. We cant afford to pay out of our pocket also for his front end and the rear end of the first car. Shouldnt those damages be covered by the car I hit because he was obviously following to close to the car in front of him? Im a little freaked out with all this, this is the first accident I have ever been in and we have always had insurance, so we thought. The insurance company did say they mailed us a cancellation notice but if they did we have never received one.

FYI: this falls under New Mexico laws I drove a small 2 door honda civic and was on my way to school. There was alot of traffic being it was around lunch time and i was approaching an intersection when this dodge durango came out of nowhere and tried to cross in front of me. (I had the green light) I tried to brake and swerve but my driver side front end hit her passenger front end. I didnt have insurance at the time of the accident and she came and said it was completely her fault and that she went because the other drivers were waving her to go ahead and go. She was 19 with no DL so ended up getting 2 tickets. I, on the other hand,didnt get any tickets and took an ambulance to the E.R. being i was having bad chest pain so my husband emptied the car because it was pretty much totalled. So, since ive never been in an accident before, what steps can i take to make sure she pays for this? I have a disabled husband, a 6 year old child, and now without a car with injuries i cant afford to have right now.

I am deciding between a 2001 nissan altima with 58,000 miles and a 2000 nissan maxima with 82,000 miles for my first car. The altima costs $6800 and the maxima costs $7500(it has alloy wheels, leather, sunroof...). I am a 16 year old guy. I got a quote for $1700 a year for insurance on the altima already. How much more would insurance cost on the maxima since it is a v6 and the altima is a 4 cylinder? Thanks for the answers!!
